Triple murder case in Ashok Nagar to transfer the CB CID

The Madras High Court on Monday said it was of the view that if the Chennai Police is not able to solve a triple murder case in Ashok Nagar within four weeks, the Commissioner of Police will request the State Government to transfer the case to the CB CID.
Madras High Court
The crime relates to the murder of Saravanan, his wife Kasturi and a female domestic worker , Anbarasi, in November 2008.

The First Bench comprising Chief Justice H.L. Gokhale and Justice K.K. Sasidharan passed the order while disposing of a petition by S.D.S. Rajadhevan, a city advocate. The petition had been filed in public interest to bring to light the number of murders that had occurred in Ashok Nagar here.

The petitioner, a retired Superintendent of Police, CB CID, said as a resident of Ashok Nagar he was rudely shocked and affected seeing the sorry state-of-affairs of the police, particularly in the investigation of murder cases which remained unresolved.

Despite the infrastructure and manpower, the police were unable to put in their best to protect the public and bring the culprits to book immediately. There was little or no coordination, supervision or detection of property cases and grave crimes.

His main prayer was a direction to the authorities to transfer all the murder cases of Chennai Police for further investigation by CB CID or CBI so as to ensure proper investigation and to restore public confidence.

The Government Pleader had earlier filed a report pointing out how security arrangements in the locality (Ashok Nagar) had been enhanced.

It was also stated that though there were 19 murders in the area since 2008, 18 had been promptly detected. It was only one case of triple murder which remained unsolved.

The Commissioner of Police in his affidavit submitted that 10 special teams had been formed to look into the case and it was hoped that investigation would move towards its logical conclusion and that the accused would be arrested.

On the prayer to transfer the case to CB CID, it was stated in the counter that if there was any difficulty in solving the case, the Commissioner would not hesitate to request the government to hand over the case to CB CID.

The Bench said, however, no time limit had been specified for completing this exercise. It was quite natural it would be difficult to specify any time limit in this regard. At the same time, there was justification in the petitioner’s anxiety for early action. The triple murder case had remained unresolved for more than a year now.

The court said the petitioner may assist the authorities in the matter of investigation of the case.

CBI filed the chargesheet accusing 31 advocates, a law student & 5 police personnel

A week after the Central Bureau of Investigation (CBI) filed a chargesheet in connection with the bloody clash between police and advocates on the Madras High Court premises in February last year a Magisteral Court today commenced the trial, even as advocates lodged their protest, stating it was a ‘defective chargesheet’.

After the CBI filed the chargesheet on January 12, accusing 31 advocates, a law college student and five police personnel, the Additional Chief Metropolitan Magistrate Killivalvan took cognisance of the same and commenced trial, amid protest by the advocates.

When the case came up for hearing, the Madras High Court Advocates Association and Tamil Nadu Advocates Association filed petitions stating that the chargesheet was one-sided and the Court should not accept it.

The Magistrate ordred issuance of notice to the CBI and adjourned the case for tomorrow.

Madras High Court Advocates Association President R C Paul Kanagaraj, appearing before the court on behalf of the accused laweyrs, said the CBI had filed the chargesheet without proper investigation.

It was a defective chargesheet as the investigating agency had not conducted proper investigation before arraigning 31 advocates in the case, he said and pointed out that the CBI had accused only five police personnel, while requesting departmental action against 22 police personnel.

If departmental action was recommended against the 22 other policemen, it meant they erred in their duty and in that case, why they were not included as accused in the chargesheet, Mr Kanagaraj asked.

When the CBI itself said they committed excesses, why they were not included as accused, he also contended.

CBI registers case against railway official in Chennai

CHENNAI:

The Central Bureau of Investigation on Saturday registered a case against a senior official and others of Southern Railway on charges of misusing official position, cheating and criminal conspiracy.

According to a agency source, a special team of the CBI’s Anti-Corruption Branch conducted a raid on Chennai Central, Chennai Egmore and other suburban stations early on Saturday based on information that private contractors were being allowed to run stalls “illegally,” causing a huge loss to the Railways.

It came to light that at least 50 stalls were operating without licence or any other valid document authorising their business. Though their contract period expired on June 30 this year, they continued to operate.

“Those who were awarded fresh contracts by the Indian Railways Catering and Tourism Corporation (IRCTC) to run the stalls from July 1 could not enter the premises as the previous contractors did not vacate. The new contractors even lodged their protest by writing to the authorities concerned. But no tangible action was taken,” a CBI official said.

As per the Catering Policy of the Indian Railways introduced in December 2005, all stalls should be handed over to the IRCTC for operation. In Chennai Division, the transfer could not take place owing to various problems.

“Instructions were finally given that contractors operating the stalls shall vacate by June 30. Tenders were called for by the IRCTC and fresh contracts worth Rs. 3.85 crore were awarded to others. However, they (the new contractors) could not take over,” the official said.

Investigations revealed that Senior Divisional Commercial Manager K. Yesuratnam of Chennai division had permitted the stall operators to continue. They were initially given a month’s extension. “They continued even after that…the month-long extension itself is unauthorised. This has resulted in a wrongful loss to the Railways. We have registered a case against Yesuratnam and others under Section 13 (1) (d) of the Prevention of Corruption Act, 1988, and Section 420 (cheating), 120 (b) (criminal conspiracy) of IPC,” he added.

Investigators searched the residence of the official. Raids continued in stalls across the division till late on Saturday. Similar checks would be conducted at all major stations in the zone, including Madurai, Coimbatore and Tiruchi, CBI sources added.

CBI probing supply of escalators, elevators for MRTS stations in chennai

CHENNAI:

The Central Bureau of Investigation is probing alleged irregularities in the supply, installation and commissioning of escalators and elevators at ten stations of the Mass Rapid Transit System (MRTS) here.

According to agency sources, a joint inspection conducted by the CBI last week along with technical experts and vigilance officials from Southern Railway revealed that 14 escalators were not functioning.

Six of the 17 elevators were found not to be operational. At Taramani, two escalators, each worth about Rs. 50 lakh, remained packed on the station premises for months.

“A prima facie case has been made out. It appears that the companies (who were awarded the contract to supply, install and commission the escalators) colluded with some officials and supplied sub-standard escalators. The payment has been made as if the escalators were provided in order and as per the specifications of the agreement,” a Superintendent of Police in the CBI said.

Since many escalators and elevators were not functioning, it has become difficult for passengers, particularly senior citizens, physically challenged and women, to take the stairs and reach the station.

“The poor quality of escalators/elevators also put the safety of passengers at stake. The patronage of the MRTS services would have been affected due to inadequate infrastructure, causing wrongful loss to the railways,” he said.

Files pertaining to the escalator and elevator works that were taken up between 2004 and 2007 were seized by the Anti-Corruption Branch of the CBI for investigation.

“Though the escalators were not installed at some stations, the contract for maintaining them was awarded. The agency is preparing to take action against some officials in the Chennai Division of Southern Railway who are responsible for the irregularities.”

The CBI had already registered a case in connection with sub-standard work in the construction of station buildings under the MRTS scheme in which a retired Deputy Chief Engineer was named as accused, the official added. When contacted Additional General Manager (Southern Railway) V. Carmelus said the railways had entered into an annual maintenance contract with the manufacturers of the escalators.

As on date, 22 of the 31 escalators were not functioning.

“We have given instructions to the suppliers to ensure that the escalators are made operational at the earliest. By the end of September, all of them will become functional. All the 30 elevators in the MRTS stations are functioning now,” Mr. Carmelus added.
