PIL seeks to end quarrying to protect heritage site

Highlighting the environmental and social havoc caused by indiscriminate blasting at stone quarrying units in the state, a public
interest writ petition has been filed seeking to end illegal quarrying at Thiruneermalai town near here.

The first bench comprising the chief justice HL Gokhale and justice N Paul Vasanthakumar, admitted the PIL filed by the Tamil Nadu Vivasayigal Sangam general secretary K Balakrishnan, and issued notices to revenue and mining departments besides the Tamil Nadu Pollution Control Board.

The petitioner said though the ancient temple town of Thiruneermalai in Kancheepuram district is a heritage site, open blast mining is done by lease-holders who used heavy bore machines despite a ban such equipment.

“They use powerful explosives during day and night, and use deep rig explosives and machines to break stones,” Balakrishnan said, adding that every building in the town, including the ancient temple, has developed cracks.

Residents of the town have developed serious respiratory problems, women have suffered reproductive problems and children’s health too has been affected, the PIL said. Every pollution control regulation concerning drilling, blasting, loading and transport of stone is being violated by the lease-holders, who use money and men to threaten those who raised voice against the violations.

Claiming to possess videographic and photographic evidence to the havoc, the petitioner said that similar quarrying operations were being carried out in various quarries throughout the state. “Officials, who have to enforce the lease conditions and enforce the statutory provisions, have become silent spectators of the breach, which is being done with utmost impunity,” the PIL said.

It wanted the court to declare the leases issued to the quarries in Thiruneermalai town as illegal, and direct the officials to restrain the lease-holders from operating the quarries. Appropriate directions shall also be issued for the remediation of the site and compensation be ordered to restore the temple and other buildings, besides the residents of the town,
